(١) اذا قـدم شخص لآخر عمدا جواهر غير مضرة فى الواقع اعتقادا منه بامكان تسبب الموت عنها وذلك لجهله المقدار الكافى من السم لاحداث الوفاة اعتبر فعله شروعا لأن الجريمة انما خابت لأسباب لادخل لارادة الفاعل فيها (٢) وينتج مما تقدم أنه لا يشترط فى الحكم القاضى بالادانة لشروع فى القتل بالسم أن يشير الى أن كمية السم المقدمة كانت كافية لاحداث الموت لأن هذه الواقعة لاتكون ركنا من أركان الجريمة

STATE REPRESENTATIVE. I. Attempted poisoning—Failure to accomplish crime by reason of inadequacy of means employed.—II. Judgment (criminal)—Contents. (P.C. Arts. 45 and 197 : C.Cr.Pr. Art. 149.) I.—Where a person, in ignorance of the amount of a poisonous substance necessary to cause death, wilfully administers to another a quantity which, though harmless in fact, is in his belief capable of causing death, the offence fails of effect owing to circumstances independent of the will of the offender who is therefore guilty of an attempt. II.—It follows from (I) that it is unnecessary for a judgment convicting of attempted poisoning to state the fact that the amount of the poisonous substance administered was sufficient to cause death, this fact not being a necessary element of the offence. I. Tentative d'empoisonnement — Crime manquant son effet à raison de faiblesse des moyens employés. II. Jugement pénal — Mentions. (C.P. art. 45, 197 ; C.I.C. art. 149.) I. — Lorsqu'une personne, dans l'ignorance de la quantité de poison nécessaire pour causer la mort, administre volontairement à une autre personne une dose qui, bien qu'inoffensive en fait, était dans sa pensée suffisante pour causer la mort, le crime manque son effet à cause de circonstances indépendantes de la volonté du délinquant, qui se rend coupable d'une tentative. II. — Il résulte de (1) qu'il n'est pas nécessaire que le jugement qui condamne pour tentative d'empoisonnement mentionne le fait que la dose administrée était suffisante pour entrainer la mort, ce fait n'étant pas un élément essentiel du crime.
