المبادئ المستخلصة
(١) قيمة الفائدة الربوية تعتبر من الوقائع الأساسية التى يجب بيانها عن كل واقعة من وقائع الربا فى الحكم القاضى بادانة المتهم لتعوده الاقراض بالربا الفاحش ولذلك يترتب على اغفالها بطلان الحكم بطلانا جوهريا (٢) اشتراط الفوائد الربوية عن مجموع قرضين مختلفين فى الزمن ضما لبعضهما كرأس مال واحد يعتبر واقعة ربا واحدة لا تتكون منها عادة الاقراض بالربا (٣) لمحكمة النقض والابرام حق النظر فى وجه البطلان المبنى على وجود بطلان جوهرى فى الحكم وقبوله ان كان على أساس ولو انه لم يرتكن عليه صراحة فى تقرير النقض الا انه مع ذلك واضح ضمنا وبوجه الضرورة رفعت الدعوى العمومية على المتهم لتعوده الاقراض بالربا وأثبت التحقيق الوقائع الآتية : فى يوليه سنة ١٩١٢ أقرض المتهم مبلغا للمجنى عليه بفوائد ربوية وأعقب هذا القرض بقرض آخر فى اكتوبر بمبلغ مائة جنيه بمقتضى كمبيالتين مختلفتين مؤرختين ٢٥ اكتوبر سنة ١٩١٢ ومحكمة الجنح حكمت بادانة المتهم بناء على ماقررته من أن عادة الاقراض بالربا تتكون كفاية من قرضين ربويين مستقلين ولكنها لم تبين قيمة الفوائد المشترطة عن القرض الحاصل فى يوليه ومحكمة النقض والابرام قررت : (أولا) ان الكمبيالتين المحررتين فى ٢٥ اكتوبر عن قرض المائة جنيه تعتبران عن واقعة ربا واحدة (ثانيا) اغفال ذكر قيمة الفوائد المشترطة عن قرض يوليه يعتبر سببا لبطلان الحكم بطلانا جوهريا

STATE REPRESENTATIVE. [I.] Cassation—Rate of usurious interest—Omission to state material facts.—II. "Habit of lending at usurious rates."—III. Implied objection—Power of Court of Cassation to entertain. (I and II, P.C. Art. 294 bis ; III, C.Cr.Pr. Art. 231.) I.—The rate of interest charged is a material [f]act which must be stated in the judgment convicting of habitually lending at usurious rates of interest, and a judgment which omits to state the rate of interest charged on each separate occasion will therefore be quashed for substantial defect. II.—The "habit of lending at usurious rates" of interest is not established by proof of two loans distinct as to time but which constitute only one transaction and one capital debt in respect of which the usurious rate was charged. III.—An objection on the ground of substantial defect of a judgment which, though not expressly raised by the motion, is necessarily and clearly implied, may be entertained, and, if established, acted on by the Court of Cassation. Proceedings were brought against the accused charging him with the offence of habitually lending at usurious rates of interest, and the evidence established the following facts :— In July 1912 the accused had made a loan at an usurious rate of interest, and again in October 1912 had advanced, also at an usurious rate, another sum of L.E. 100, which sum was, for convenience, secured by two separate bills of exchange, both dated October 25, 1912. The Central Tribunal convicted the accused, being of opinion that the habit of lending at ururious rates is sufficiently constituted by two distinct loans at usurious rates, but in the judgment of conviction the rate of interest charged in respect of the loan in July was not stated. Held, by the Court of Cassation: (I) that the loan of L.E. 100 made in October 1912, though secured by two separate bills, constituted only one transaction, and (II) that as the judgment of the Central Tribunal omitted to set out the material fact of the rate of interest of the previous loan of July 1912, it should be quashed for substantial defect.

Cassation — Taux d'intérêt usuraire — Omission d'un fait matériel. II. Habitude de prêter à un taux usuraire. III. Exception impliquée par le pourvoi mais non exprimée — Pouvoir de la Cour de Cassation de l'admettre. (I. et II. C.P. art. 294 bis ; III. C.I.Cr. art. 231.) I. — Le taux de l'intérêt conventionnel est un fait matériel qui doit être visé dans le jugement qui condamne pour usure habituelle, et le jugement qui omet d'indiquer le taux conventionnel de chacun des cas pris séparément doit, par conséquent, être cassé pour nullité substantielle. II. — L'habitude de prêter à intérêts usuraires n'est pas établie par l'existence de deux prêts distincts quant au temps, mais qui constituent une seule opération et une dette principale au sujet de laquelle l'intérêt usuraire a été stipulé. III. — Une exception qui s'appuie sur une nullité substantielle d'un jugement, qui, bien que non expressément contenue dans le pourvoi, y est nécessairement et clairement impliquée peut être reçue par la Cour de Cassation, et si elle est constatée bien fondée, elle peut être admise. Les poursuites avaient été intentées contre le prévenu du chef d'usure habituelle, et les faits suivants avaient été prouvés : En juillet 1912, le prévenu avait consenti un prêt à un intérêt usuraire et de nouveau en octobre 1912, avait avancé, aussi à un intérêt usuraire, une autre somme de L.E. 100, somme qui fut garantie par deux billets à ordre différents, tous deux datés du 25 octobre 1912. Le Tribunal du Centre condamne le prévenu, étant d'avis que l'habitude de prêts usuraires était établie à suffisance de droit, par deux prêts distincts à taux usuraire, mais dans le jugement de condamnation le taux de l'intérêt stipulé pour le prêt de juillet, n'avait pas été mentionné. Jugé par la Cour de Cassation (1) que le prêt de L.E. 100 fait en octobre 1912, bien que garanti par deux billets séparés constituait une seule opération et (2) que, parce qu'il avait omis de faire ressortir le fait matériel du taux de l'intérêt afférent au prêt antérieur de juillet 1912, le jugement du Tribunal du Centre devait être cassé pour nullité substantielle.
