المبادئ المستخلصة
(١) للمحكمة الاهلية عند نظر دعوى نزاع فى وضع اليد بين شخصين يدعيان النظارة على أراض موقوفة أن تفصل فى صفة النظر المتنازع فيها . ومن ثم فلا يتعين ايقاف الدعوى لحين الفصل فى ذلك من المحكمة الشرعية (١) (٢) لناظر الوقف المعين من قبل المحكمة الشرعية الحق دون سواه فى ادارة أموال الوقف اذا كان الناظر المعين من قبل الواقف قاصرا ومن ثم اذا أجر القاصر أو وصيه أعيان الوقف كان الايجار باطلا (٣) يتلقى الوارث المستحق فى وقف حقه عن الواقف الأصلى لا عن مورثه . ولذلك لا يكون المستحق مسؤولا عن ديون مورثه التى على التركة . وفى هذه الدعوى حكمت المحكمة ببطلان عقد الايجار الصادر من ناظر الوقف المشترط فيه أن مبلغ الايجار يخصم نظير ما للمستأجر من الديون على مورث المستحقين (١) أنظر حكم محكمة مصر الابتدائية الرقيم ٩ مارس سنة ١٩١٠ (المجموعة الرسمية السنة الثانية عشرة نمرة ٢٨)

NASR MATTROUS AND OTHERS. Wakf—I. Jurisdiction of the Native Tribunals (limits)—Title to office of Nazir—Judicial and Original Nazir—II. Lease by guardian of Nazir under age—Nullity—III. Title of heirs of beneficiary of Wakf. (Decree of Reorg., Art. 16.) I.—When there is a dispute as to the possession of Wakf property between two persons claiming to be Nazirs, the Native Tribunals are competent to decide incidentally the title to the office of Nazir, and need not suspend the case for the judgment of the Mahkama Sharia on the point. II.—A Nazir appointed by the Court has the exclusive right of administering the Wakf property, while the Nazir appointed by the constituent is a minor. A lease of the Wakf property made by the guardian of the minor Nazir is void. III.—The heirs of a beneficiary of a Wakf who are themselves beneficiaries derive their title to benefit by it from the constituent of the Wakf, and are therefore not liable for the debts of their de cujus in respect of the property. A lease made by the Nazir which discharges the lessee from the payment of rent in satisfaction of the lessee's claim against the de cujus of the beneficiaries is null. For I. Cf. Trib. ADMINISTRATION DES WAKFS contre NASR MAHROUSS ET AUTRES. Wakf — I. Compétence des Tribunaux Indigènes (limites) — Titre pour la fonction de Nazir — Nazir Judiciaire et élu. II. Bail par le tuteur d'un Nazir mineur — Nullité. III. Titre des héritiers du bénéficiaire d'un Wakf. (Décret de Réorganisation, art. 16.) I. — Lorsqu'il y a contestation quant à la possession d'un bien Wakf, entre deux personnes qui se prétendent Nazir, les Tribunaux Indigènes sont compétents pour statuer incidemment sur le titre de la fonction de Nazir; il n'est pas nécessaire de renvoyer le procès pour que le Mehkémeh Sharieh statue sur ce point. II. — Lorsque le Nazir nommé par le constituant du Wakf est mineur, le Nazir nommé par le tribunal a le droit exclusif d'administrer le bien Wakf. Le bail d'un bien Wakf consenti par le tuteur d'un Nazir mineur est nul. III. — Les héritiers du bénéficiaire d'un Wakf qui sont eux-mêmes bénéficiaires tiennent du constituant du Wakf leur titre à en jouir : par conséquent, ils ne sont pas tenus des dettes de leur de cujus se rapportant à la propriété. Un bail consenti par le Nazir qui dégrève le preneur du paiement d'une redevance pour avoir abandonné sa demande contre le de cujus des bénéficiaires, est nul. Voir Trib. du Caire, 9 mars 1910 (B.O.
