المبادئ المستخلصة
(١) تعتبر الدعوى مقامة أمام المحكمة بمجرد اعلان الخصم بصحيفتها وان لم تقيد بالجدول العمومى . ومن ثم فلا يشترط القيد لبدء سريان المدة اللازمة لانقطاع المرافعة والتى يترتب عليها الحكم بالبطلان (٢) اذا رفع المدعى دعوى استرداد وأعلن خصمه بصحيفتها ثم اقتصر على ذلك دون أن يتخذ اجراآت أخرى انما رفع دعوى أخرى أمام المحكمة الشرعية لاثبات وراثته للعقار موضوع النزاع فدعواه الأخيرة تعتبر من الاجراآت الصحيحة المانعة لبطلان المرافعة فى الدعوى الأولى لأن الدعويين مرتبطتان ارتباطا شديدا ببعضهما (١) ومن جهة أخرى اذا أنذر المدعى خصمه رسميا بعد صدور الحكم الشرعى بأن لايتصرف فى الارض المتنازع فيها فهذا الانذار لايعتبر من الاجراآت الصحيحة فى الدعوى الاصلية ولا يمنع بطلان المرافعة اذا استمر انقطاعها لمدة ثلاث سنوات أخرى (٣) ليس للخصم الذى صدر الحكم الغيابى فى مواجهته أن يبدى طلبات جديدة عند حصول المعارضة لأن الحكم حضورى بالنسبة له . ولكن هذا الدفع مما يجب ابداءه صراحة أمام المحكمة لأنه انما وضع لمحض مصلحة الاخصام (٢) (١) أنظر حكم محكمة الاستئناف المختلطة الرقيم ٢٨ مارس سنة ١٩٠٠ (مجموعة التشريع والاحكام المختلطة السنة الثانية عشرة صحيفة ١٨٠) وحكم المحكمة المذكورة الرقيم ١٣ مارس سنة ١٩٠١ (مجموعة التشريع والاحكام المختلطة السنة الثالثة عشرة صحيفة ١٩٦) (٢) أنظر حكمى محكمة الاستئناف المختلطة الصادرين فى أول ابريل سنة ١٩٠٣ و ٦ مايو سنة ١٩٠٣ (مجموعة التشريع والاحكام المختلطة السنة الخامسة عشرة صحيفتى ٢١٩ و ٢٧٠)

EL SITT SHARIFA, WIFE OF MUHAMMAD NOURY EFFENDI AND ANOTHER Civil procedure—I. Peremption—Commencement of action.—II. Concurrent action in Muhammadan Courts—Steps in procedure.—III. Judgment by default—Effect as regards successful party—Exception—Private interest. (C.C.C.Pr. arts. 33, 300, 301. 363.) I.—Service of the summons on the other party constitutes a commencement of the action; and it is not necessary that the action should be entered on the general cause-list in order that the period of interruption which justifies a demand for peremption should begin to run. II.—Where a summons in a revindication suit before the Native Courts is served on the other party, and the plaintiff, though taking no other step in these proceedings, brings another action before the Muhammadan Courts, to establish his title to the property as heir, this constitutes a valid step in procedure which covers the peremption, since the second action is closely connected with the first. A formal notification, served on the defendant after judgment in the action before the Muhammadan Courts, not to dispose of the land in dispute, does not, however, constitute a valid step in procedure and will not cover the peremption of the original action, where the plaintiff has taken no other step during the three years following the judgment. III.—The party who has obtained judgment by default is not entitled, on opposition, to bring a fresh claim upon the same point, because, as regards him, the judgment is contested; but an exception on this ground is of private interest, and must be expressly raised before the Court. The plaintiff brought an action of revindication in 1902, but did not enter it in the cause-list or take any further step in it. Subsequently he started an action in the Muhammadan Courts to establish his title to the land by succession, and obtained judgment. The defendant in 1911 applied to the juge préparateur for a declaration that the original action was perempted and obtained judgment by default. On the plaintiff making opposition, the defendant made a fresh claim for peremption, on the ground that no step in the procedure had been taken for a period of more than three years from the judgment in the action before the Muhammadan Court. The Central Tribunal reversed the judgment of peremption; but it was held by the Court of Appeal that, although the defendant was not entitled, on opposition, to bring a fresh claim for peremption, the plaintiff must be deemed to have waived the exception on this ground, and that the original action was perempted by the lapse of three years since the judgment of the Muhammadan Court, uninterrupted by any valid step in the procedure. I. — La signification de l'assignation à la partie adverse forme le commencement de l'instance ; il n'est pas nécessaire que l'affaire soit inscrite au rôle général pour que commence à courir cette période interruptive qui justifie une demande en péremption. II. — Quand une citation dans un procès en revendication devant les Tribunaux Indigènes est signifiée à la partie adverse, et que le demandeur, bien que n'usant pas d'un autre mode de procédure, introduit une autre action devant les Tribunaux Musulmans pour établir son droit en qualité d'héritier, ceci constitue un acte de procédure valable qui couvre la péremption, puisque la seconde action est étroitement liée à la première. Une notification formelle signifiée au défendeur après le jugement dans l'affaire soumise aux Tribunaux Musulmans, de ne pas disposer de la terre contestée, ne constitue pas, cependant, un acte valable de procédure, et ne couvre pas la péremption de l'action originelle, lorsque le demandeur n'a pas accompli d'autres actes de procédure pendant les trois années qui ont suivi le jugement. III. — La partie qui a obtenu un jugement par défaut ne peut, sur opposition, présenter une nouvelle demande sur le même point, parce que, par rapport à lui, le jugement est contradictoire ; mais une exception de cette nature est d'intérêt privé et doit être formellement soulevée devant la Cour. Le demandeur avait introduit une action en revendication en 1902, mais ne l'avait pas inscrite au rôle général ni n'avait accompli aucun acte de procédure subséquent. Plus tard, il avait intenté une action devant les Tribunaux Musulmans pour établir son droit sur la terre en qualité d'héritier et avait obtenu jugement. En 1911, le défendeur s'était adressé au Juge-Préparateur pour faire déclarer que l'action originelle était périmée, et avait obtenu un jugement par défaut. Sur opposition du demandeur, le défendeur formule une demande nouvelle de péremption sur ce qu'aucun acte de procédure n'avait été accompli dans une période de plus de trois ans depuis le jugement rendu par les Tribunaux Musulmans. Le Tribunal de Centre annula le jugement de péremption, mais la Cour d'Appel jugea que, bien que le défendeur ne pût sur opposition introduire une demande nouvelle de péremption, il y avait lieu de considérer que le demandeur avait renoncé à une exception de cette nature, et que l'action originelle était périmée par le délai de trois années depuis le jugement du Tribunal Musulman, délai que n'avait interrompu aucun acte de procédure valable.
