اتفق ابن مع أبيه أحد تجار القماش فى المنيا ان لايشتغل فى تجارة القماش أو يســتخدم عند أحد التجار المشتغلين فيه فى تلك الجهة وفى مقابل ذلك تعهد الوالد انه مادام على قيد الحياة يدفع لابنه شهريا مبلغا قدره مئتى قرش حكمت المحكمة بان اتفاقا كهذا لايعتبر باطلا لانه لايخالف النظام العام ولو ان فيــه مصادرة لحرية التجارة اذ ان المصادرة كانت مقصورة على تجارة معينة ومحــل معين ولو انها كانت لأجل غير محدود (١)

TRIBUNAL OF BENI SUEF (Judgment on appeal) 22 APRIL 1913. MM. Ali Saleh Bey (Pres.) : Rafferty, Mahmoud Fouad Effendi (JJ.). EL SHEIKH HASSAN ALI SOLEIMAN v. SAYED HASSAN ALI SOLEIMAN Contract—Restraint of Trade—Agreement not to carry on Trade—Validity. A son agreed with his father who was a dealer in cloth at Minia that he would not carry on or be employed in the like business at Minia, and in consideration thereof, the father promised that during his life he would pay to the son a monthly sum. Held, that such an agreement was not void as contrary to public policy, although in restraint of trade, since, although the restraint was indefinite in point of time, it was restricted to a certain trade and to a certain place. TRIBUNAL DE BENI SOUEF (Jugement en appel) 22 AVRIL 1913. MM. Ali Sakeb Bey (Prés.); Rafferty, Mahmoud Fouad Effendi (JJ.). EL CHEIKH HASSAN ALI SOLIMAN contre SAYED HASSAN ALI SOLIMAN Contrat—Restriction à la liberté du commerce—Validité. Il a été convenu entre un fils et son père lequel était marchand d'étoffes à Minieh, que le fils ne pourrait pas y exercer ce commerce ni être employé dans un commerce similaire, moyennant l'engagement du père de lui payer, sa vie durant, une certaine somme mensuellement. Il fut jugé qu'une telle convention ne dépasse pas les bornes d'une convention licite, quoique portant atteinte à la liberté du commerce, parce que la restriction stipulée, indéfinie quant au temps, était pourtant restreinte à un certain lieu et à une certaine industrie.
