المبادئ المستخلصة
ليس لمستحق الوقف طلب الحساب مباشرة من الناظر عن ادارته (١) . لأن هـذا الحق خاص بالقـاضى الشرعى الذى له ان يحاسب الناظر من تلقاء نفسه أو بناء على طلب المستحقين وفى حالة تكليف الناظر بتقديم الحساب فقـد جرت العادة بأن يقدم الحساب مرة واحـدة فى السـنة بحيث لايجوز تكليفه بتقديمه أكثر من مرة فى السنة حتى ولو ثبت ان الناظر اعتاد تقديم حساب شهرى (١) انظر عكس ذلك حكم محكمة الاستئناف المختلطة الرقيم ٢٩ ابريل سنة ١٨٩٦ (مجموعة التشريع والاحكام المختلطة السنة الثامنة صحيفة ٢٥٣) وكتاب الوقف لكلافيل الجزء الثانى صحيفة ٧١ وما يليها

COURT OF APPEAL 11 FEBRUARY 1913. MM. Hassan Galal Bey (Pres.); Alston, Mina Ibrahim Bey (JJ.). SARAH HANEM BINT HASSAN EFFENDI KASHIF v. ALY EFFENDI HASSAN KASHIF Wakf—Accounts demanded from nazir by beneficiaries. Beneficiaries of a wakf are not entitled to demand accounts of the administration directly from the nazir. (1) The judge of the Mehkemeh Sharieh alone can call for such accounts, either of his own motion or at the instance of the beneficiaries. When accounts are ordered, it is the practice for the nazir to deliver them yearly, and they cannot be demanded for a shorter period, even though the nazir has been in the habit of rendering a monthly account. SARAH HANEM BINT HASSAN EFFENDI KACHIF contre ALI EFFENDI HASSAN KACHIF Wakf — Comptes du nazir réclamés par bénéficiaires. Les bénéficiaires d'un wakf ne sont pas en droit de réclamer directement au nazir les comptes de son administration (1). C'est le juge du Mehkémeh Charieh seul qui peut exiger ces comptes, soit d'office, soit sur la requête des bénéficiaires. Quand il est ordonné au nazir de présenter ses comptes, il est d'usage qu'il les rende annuellement, et ils ne peuvent être réclamés plus souvent, bien que le nazir ait eu l'habitude de les rendre mensuellement.
