طلب المدعى تعويضا لما لحق منزله من الضرر الناشئ عن حفر آبار بأرض مجاورة له فحكم بأنه وان كان السبب الأساسى للضرر هو حفر الآبار المذكورة إلا أن جسامة الضرر نتجت فى الواقع عن الضعف الذى ثبت وجوده بأساس المنزل . فلذا يتعين تخفيض التعويض المطلوب (١) (١) راجع كتاب سوردا عن المسؤولية (الطبعة الخامسة) الفقرات ١٠٨ و ٤٤٠ (٤) و ٦٦٠ و ٦٩٠

SHEIKH MUHAMMAD RASHID EL RIFAII Tort—House damaged by wells—Weak foundations—Measure of damages. (C.C. art. 151.) In an action for damages in respect of injury caused to a house by wells being sunk on the adjoining land, it was held that, although the sinking of the wells was the principal cause of the injury, yet, as it was proved that the extent of the injury was increased owing to the weakness of the foundations of the house, the amount of damages claimed must be reduced. EL-SITT MINOAR HANEM ISMAIL contre CHEIKH MOHAMED RACHID EL RIFAII Responsabilité civile — Maison endommagée par puits — Fondations faibles — Evaluation des dommages-intérêts. (C.C. art. 151.) Dans une action en dommages-intérêts pour préjudice causé à une maison par le fait de creuser des puits dans le terrain voisin, il fut jugé que, quoique le creusement des puits fût la cause principale du préjudice, cependant, comme il était prouvé que l'étendue du préjudice avait été augmentée par la faiblesse des fondations de la maison, les dommages-intérêts réclamés devaient être réduits.
