المبادئ المستخلصة
لايترتب عــلى وجود زيادة فى التنبيه الحاصــل للمـدين الحكم بلغو ورقة التنبيــه لان تلك الزيادة لاتستلزم بطلان التنبيه الذى لم يفـقد فى الحقيقة ركنا من أركانه وانما يجب فى هذه الحـالة ان يرد الدين الى حقيقة المستحق أداؤه ويـلزم الدائن اذا اقتضى الحـال بمـا ترتب على هذه الزيادة من المصاريف
Summary (English)
Circular of the Committee of Judicial Surveillance. — 28 December 1899, No. 15. Notice of execution—Claim exaggerated. A notice of execution, which purports to be for a sum exceeding that really due, should not on that ground be declared null and void, but only amended by the insertion of the correct amount. The execution creditor may, in the discretion of the Court, be ordered to pay the extra costs occasioned by the excessive nature of his claim.

Circulaire du Comité de Surveillance Judiciaire. — 28 décembre 1899, N° 15. Commandement — Demande exagérée. Un commandement fait pour une somme excédant celle réellement due, ne doit pas être annulé de ce chef, mais seulement réduit jusqu'à due concurrence. Au besoin peuvent être mis à la charge du créancier poursuivant, les frais occasionnés par l'exagération de sa demande.
