COURT OF APPEAL 11 DECEMBER 1912. MM. Ahmad Zulfikar Bey (Pres.) ; Marshall, Amin Aly Bey (JJ.). HAMADALLAH AWAD ABDEL MOGITH AND ANOTHER v. MUDIRIEH OF KENA AND OTHERS Tort—Master and servant—Liability of Government Department. (C.C. art. 152.) A Government Department is subject to the ordinary liability of an employer for the negligence of its servants in the execution of their duties. The fact that a Government servant has been required to find a surety on entering the service does not affect the direct liability of the Department to indemnify a person who has suffered loss through the negligence of that servant. HAMADALLAH AWAD ABDEL MOGITH ET AUTRE contre MOUDIRIEH DE KÉNEH ET AUTRES Responsabilité civile — Patron et employé — Responsabilité d'une administration gouvernementale. (C.C. art. 152.) Toute administration gouvernementale est soumise à la responsabilité ordinaire d'un patron pour les négligences de ses employés dans l'exécution de leurs fonctions. Le fait qu'un employé du gouvernement a fourni un garant au moment d'entrer en service n'influe aucunement sur la responsabilité directe de l'administration envers celui qui a subi une perte par la négligence de cet employé.
