التوافق على التعدى المنصوص عنه فى المادة ٢٠٧ عقوبات لا يستوجب اتفاق سابق على المضاربة . فلذا تنطبق المادة ٢٠٧ على الاشخاص الذين انضموا الى معركة بين فريقين حين علمهم بحصولها (١) ( ١ ) راجع حكم محكمة النقض والابرام الرقيم ٢٢ مايو سنة ١٨٩٧ (القضاء السنة الرابعة صحيفة ٣٦٧)

MUHAMMAD HUSSEIN MARII AND OTHERS v. STATE REPRESENTATIVE Assault—" Acting in concert "—Meaning. (P.C. art. 207.) The words "acting in concert" in art. 207 P.C. do not necessarily imply a preconcerted agreement. The article is properly applied to persons who, on hearing that a fight was in progress between two hostile bands, went and joined in the fighting. Cf. Cass. 22 May 1897 (Al Cada, IV. 367).

Les mots « de commun accord » à l'article 207 C.P. n'impliquent pas qu'il y ait eu nécessairement un accord préalable. L'article reçoit une juste application dans le cas où les accusés, en apprenant qu'une rixe avait lieu entre deux bandes hostiles, se sont empressés d'aller y prendre part. Cf.
