Summary (English)
COURT OF CASSATION 21 OCTOBER 1912. MM. Yehia Ibrahim Pasha (Pres.) ; Abdel Aziz Kahil Bey, Marshall, Amin Aly Bey, Muhammad Tewfik Nessim Bey (JJ.) ; Aly Maher Bey (State Rep.). MANSOUR EL GUEEDI AND OTHERS v. STATE REPRESENTATIVE Criminal Procedure—Signing of Judgment—Delay—Nullity. (C.Cr.Pr. arts 152, 231.) A final judgment of conviction, which has not been signed by the Judge within eight days, will be quashed, on the ground that the delay prevents the convicted person from obtaining an abstract of the judgment within that period, in accordance with art. 231 C.Cr.Pr., for the purpose of attacking the judgment before the Court of Cassation. MANSOUR EL GUEEDI ET AUTRES contre MINISTÈRE PUBLIC Procédure criminelle — Signature de jugement — Retard — Nullité. (C.I.C. arts. 152. 231.) Est entaché de nullité substantielle un jugement de condamnation en dernier ressort qui n'a pas été signé par le juge dans le délai de huit jours à partir de son prononcé, ce retard ayant pour effet d'empêcher le condamné de se faire remettre dans ce délai, conformément à l'art. 231 C.I.C., un extrait du jugement afin de se pourvoir en cassation contre lui.
