اذا لم يكن الشخص ساكنا فى المركز أو متخذا اياه موطنا له فلا يعتبر « صاحب شان » بالمعنى المقصود فى المادة « ٤٤ » من قانون الانتخاب كما هى معدلة بالامر العالى الصادر فى ١١ يونيه سنة ١٩٠٠ حتى يجوز له أن يطعن فى صحة انتخاب عضو مجلس المديرية المنتخب عن المركز المذكور (١)

TRIBUNAL OF TANTA 14 JANUARY 1911. MM. Hefny Nassif Bey (Pres.); Hassan Nabih El-Masry Effendi, Ghobrial Sidhom Effendi (JJ.); Ahmad Hegazy Effendi (State Rep.). MAHMOUD FAHMY EFFENDI AND OTHERS v. ABDALLAH ZAGHLOUL BEY Elections—Petition for invalidity—Person having right to petition. (Electoral Law of 1st May 1883, art. 44, amended by Decree of 11 June 1900.) A person who is neither resident nor domiciled in a particular Markaz is not "an interested party" within the meaning of art. 44 of the Electoral Law, as amended by the Decree of the 11th June 1900, so as to be entitled to petition for the invalidation of the election of a representative of that Markaz on the Provincial Council. MAHMOUD FAHMY EFFENDI ET AUTRE contre ABDALLAH ZAGHLOUL BEY Elections — Réclamation en invalidité — Personne ayant le droit de présenter une réclamation. (Loi électorale du 1er mai 1883, art. 44, modifié par décret du 11 juin 1900.) Une personne qui n'a ni son habitation ni son domicile dans un markaz, n'est pas une personne intéressée aux termes de l'art. 44 de la Loi électorale, modifié par le Décret du 11 juin 1900, et n'a donc pas le droit de présenter une réclamation contre la validité de l'élection au Conseil Provincial d'un représentant de ce markaz.
