يعتبر الحشيش من الجواهر السامة بالمعنى المقصود فى قانون نمرة ١٤ سنة ١٩٠٤ الصادر بشان الصيدليات (١) وعلى ذلك فبيع العقاقير المحتوية على حشيش فى غير المحلات المرخص لها بذلك يكون جريمة معاقبا عليها بمقتضى القانون المذكور (٢)

COURT OF APPEAL 30 NOVEMBER 1910. MM. Muhammad Sidky Bey (Pres.); Royle, Amos (JJ.); Muhammad Farid Bey (State Rep.). STATE REPRESENTATIVE v. MUHAMMAD KHADR Pharmacy Law—Drug containing hashish. (Law No. 14 of 1904.) Hashish is scheduled poison within the meaning of the Pharmacy Law, No. 14 of 1904, (1) and consequently the sale elsewhere than in a licensed pharmacy of drugs containing hashish is an offence under that Law. (2) (1) It appears from a certificate of the Sanitary Department in the dossier of the case that hashish falls within the terms "substances mentioned in a pharmacopœia with a maximum dose below or equal to one gramme" in the last paragraph of Schedule I of the Law. (2) Upholding Contraventional Tribunal of Cairo, 6 Sept. 1910—M. Abd-el-Hakim Askar Effendi (J.); decided as above Contraventional Tribunal of Cairo, 19 April 1909—M. COUR D'APPEL 30 NOVEMBRE 1910. MM. Mohamed Sidky Bey (Prés.); Royle, Amos (CC.): Mohamed Farid Bey (M.P.). MINISTÈRE PUBLIC contre MOHAMED KHADR Pharmacies — Drogues contenant du hachiche. (Loi N° 14 de 1904.) Le hachiche est une substance vénéneuse aux termes de la Loi sur les pharmacies, N° 14 de 1904 ; (1) aussi la vente dans un local autre qu'une pharmacie autorisée de drogues contenant du hachiche est-elle punissable du chef de cette Loi. (2) (1) D'après un certificat au dossier de l'Administration des Services Sanitaires, le hachiche est compris dans les termes «Substances inscrites dans une pharmacopée avec une dose maximum inférieure ou égale à un gramme» mentionnées dans le dernier paragraphe du Tableau 1 de la Loi.
