المبادئ المستخلصة
(١) اذا اشترك عضو مجلس المديرية فى انتخاب الاعضاء المندوبين لمجلس شورى القوانين قبل أن يستلم من نظارة الداخلية تذكرة اعتماده عضوا بمجلس المديرية طبقا للمادة «٣٧» من قانون الانتخاب فالانتخاب مع ذلك صحيح (٢) لاتطبق المادة «١٧» من قانون الانتخاب الخاصة بميعاد دعوة المنتخبين الا على انتخاب أعضاء مجالس المديريات فلا تنطبق على انتخاب الأعضاء المندوبين لمجلس شورى القوانين (٣) اذا أرسلت تلغرافات الى أعضاء مجلس المديرية أثناء اجتماعهم لانتخاب الأعضاء المندوبين لمجلس شورى القوانين بقصد التاثير عليهم ولكن لم يثبت انهم تاثروا منها بالفعل فلا يعتبر ذلك وجها مبطلا للانتخاب (٤) لاتقبل أوجه الطعن فى صحة انتخاب الأعضاء المندوبين لمجلس شورى القوانين المقدمة لأول مرة فى الجلسة أمام المحكمة

COURT OF APPEAL 1ST FEBRUARY 1911. MM. Bond (Pres.); Muhammad Mehrez Bey, Soudan (JJ.). ABDALLAH MUHAMMAD AND OTHERS v. ABD-EL-LATIF EL-SOUFANY BEY Elections—Legislative Council: I. Certificate of election of Provincial Councillors—Absence; II. Convocation of electors; III. Telegrams to influence electors; VI. Claim for invalidation—Procedure—Presentation of grounds. (Electoral Law of 1st May 1883, arts. 37, 17, 44.) I.—The vote of a Provincial Councillor at an election to the Legislative Council is valid, although he had not at the time received from the Ministry of the Interior a certificate of his election to the Provincial Council under art. 37 of the Electoral Law. II.—Art. 17 of the Electoral Law, as to the time for the convocation of electors, only applies to elections to the Provincial Councils and not to elections to the Legislative Council. III.—The fact that telegrams were sent to Provincial Councillors at the time of an election to the Legislative Council with the intention of influencing them in their votes, without any proof shewing that they were in fact influenced thereby, is not a ground for invalidating the election. IV.—A ground of a claim for the invalidation of an election to the Legislative Council which is presented for the first time at the sitting of the tribunal, is inadmissible.

Réclamation en invalidité — Procédure — Présentation de motifs. (Loi électorale du 1er mai 1883, art. 37, 17 et 44.) I. — Le vote d'un conseiller provincial lors de l'élection au Conseil législatif est valable, alors même qu'il n'a pas reçu du Ministère de l'Intérieur un certificat de son élection comme membre du Conseil provincial en vertu de l'art 37 de la Loi électorale. II. — L'art. 17 de la Loi électorale, relatif au délai pour la convocation des électeurs, ne s'applique qu'aux élections aux Conseils provinciaux et non aux élections au Conseil législatif. III. — Le fait que des dépêches ont été envoyées aux conseillers provinciaux lors de l'élection au Conseil législatif dans l'intention de les influencer dans leur vote, mais sans qu'il soit prouvé qu'ils aient été par là effectivement influencés, n'est pas un motif pour invalider l'élection. IV. — Un motif de réclamation contre la validité d'une élection au Conseil législatif, présenté pour la première fois à l'audience du tribunal, est irrecevable.
