المبادئ المستخلصة
اذا منع الزوج تنفيذ الحكم الصادر على زوجته لارتكابها الزنا طبقا للمادة «٢٣٦» عقوبات فلا يمنع ذلك من تنفيذ العقوبة على الشريك اذا كان الحكم نهائيا . وهذا بخلاف ما اذا كان الحكم ابتدائيا واستعمل الزوج حقه المخول له بمقتضى المادة «٢٣٦» عقوبات المذكورة قبل أن يحوز الحكم المذكور «قوة الشئ المحكوم به نهائيا» فان الشريك يفلت من العقاب فى هذه الحالة

Hefny Nassef Bey (Pres.); Muhammad Tewfik Sirry Effendi, Muhammad Kamel El-Rashidy Effendi (JJ.); Ibrahim Ahmad Shalaby Effendi (State Rep.). STATE REPRESENTATIVE v. ALY MUHAMMAD EL-KADI Adultery—Husband remitting penalty against wife—Effect upon conviction of paramour. (P.C. art. 236.) Where a husband has prevented the execution of a sentence for adultery against his wife under art. 236 P.C., the conviction of the paramour holds good, if the judgment convicting the parties is in last resort. But if the judgment is in first resort, and the husband has exercised his power under that article before the judgment has acquired the force of res judicata, the paramour also escapes punishment.

MINISTÈRE PUBLIC contre ALY MOHAMED EL-KADI Adultère—Remise de la peine par le mari—Effet sur la condamnation du complice. (C.P. art. 236.) Lorsque le mari d'une femme condamnée pour adultère arrête l'effet de la condamnation en consentant à reprendre sa femme conformément à l'art. 236 C.P., la condamnation subsiste à l'égard du complice, si le jugement qui les a condamnés est en dernier ressort. Si au contraire le jugement n'est qu'en premier ressort et que le mari a exercé son droit en vertu de l'article susdit avant que le jugement ne soit passé en force de chose jugée, le complice aussi échappe à la répression.
