المبادئ المستخلصة
قضت المـادة « ١٦٦ » جنايات بان يقاد الشهود لأودة تخصص لهم ولايخرجون منها الا بالتوالى لتادية الشهادة أمام المحكمة والغرض من ذلك منع الشهود الذين ستسمع شهادتهم من الوجود فى الجلسة وقت تادية شهادة الذين قبلهم . وبناء عليه لاتنطبق على حالة ما اذا تمكن الشهود الذين لم تسمع شهادتهم من الاختـلاط مع من سمعت شهادتهم أثناء الفترة التى توسطت جلستى الصباح والمساء

COURT OF CASSATION 28 JANUARY 1911. MM. Bond (Pres.); Ahmad Zewar Bey, Muhammad Safwat Bey, Muhammad Mahfouz Bey, Soudan (JJ.); Muhammad Tewfik Nessim Bey (State Rep.). EL-BAZ YOUSSEF AND OTHERS v. STATE REPRESENTATIVE AND OTHERS Witnesses—Precautions before they are heard. (C.Cr.Pr. art. 166.) Art. 166 C.Cr.Pr., providing that witnesses shall be conducted to a room set apart for them and may only leave it successively in order to give their evidence before the tribunal, is merely intended to prevent witnesses who have not yet been heard from being present in Court while the witnesses heard before them are giving their evidence, and is not applicable to a case where the witnesses who had not given their evidence had, in the interval between the morning and afternoon sittings, been permitted to communicate with the witnesses who had already been heard.

EL-BAZ YOUSSEF ET AUTRES contre MINISTÈRE PUBLIC ET AUTRES Témoins — Précautions à prendre avant leur déposition. (C.I.C. art. 166.) L'art. 166 C.I.C., disposant que les témoins seront conduits dans une chambre à eux destinée d'où ils ne sortiront que successivement pour faire leur déposition devant le tribunal, n'a été édicté que pour empêcher les témoins qui n'ont pas encore été entendus d'assister à la déposition des témoins appelés avant eux ; cet article ne s'applique pas au cas où les témoins qui n'ont pas été entendus ont, dans l'intervalle entre l'audience du matin et celle de l'après-midi, communiqué avec ceux ayant déjà déposé.
