المبادئ المستخلصة
اذا لم يعلم البائع المشترى بجميع حقوق الارتفاق أو الحقوق العينية الخفية الموجودة على المبيع وقت البيع كان البائع ملزما بالضمان ولا يكفى لبطلان ملزوميته بذلك أن يكون المشترى بحيث كان يمكنه العلم بها بل يجب أن يكون قد علم بها بالفعل وبناء عليه اذا كانت حقوق الارتفاق والحقوق العينية مبينة فى العقد الذى انتقلت بواسطته ملكية المبيع الى البائع فلا يعد مجرد ذكر تاريخ ورقم تسجيل هذا العقد فى عقد البيع دليلا على علم المشترى بهذه الحقوق كما أنه لا يعتبر مبدأ ثبوت بالكتابة يجيز اثبات علمه بها طبقا للمادة «٢١٧» مدنى لأن ذلك صادر من البائع نفسه

COURT OF APPEAL 8 MARCH 1910. MM. Ahmad Zulfikar Bey (Pres.); Alston, Muhammad Tewfik Rifaat Bey (JJ.). PRINCESS AMINA HANEM ISMAIL v. Dr. BAYOUMI EFFENDI FATHY Vendor's warranty—Non-apparent servitudes and real rights—Purchaser's knowledge thereof—Proof—Commencement of written proof. (C.C. arts. 310, 312, 217.) An action in warranty lies against a vendor who fails to disclose the existence of non-apparent servitudes or real rights with which the property is burdened at the time of the sale. To resist such an action it is insufficient to shew that the purchaser was in a position to acquaint himself with the existence of such servitudes or real rights ; he must be shewn to have actually known of their existence. In particular, when they were set out in the contract by which the vendor acquired the property, the mere mention in the contract of sale of the date and transcription number of the earlier contract is insufficient. Nor can this mention be considered a commencement of written proof, under art. 217 C.C., of the knowledge of the purchaser, since it emanates from the vendor himself.

PRINCESSE AMINA HANEM ISMAIL contre Dr BAYOUMI EFFENDI FATHY Garantie du vendeur — Servitudes et droits réels non-apparents — Connaissance de l'acheteur — Preuve — Commencement de preuve par écrit. (C.C. art. 310, 312 et 217.) La garantie du vendeur est due lorsque celui-ci n'a pas déclaré l'existence de servitudes ou de droits réels non-apparents grevant les terrains au moment de la vente. Il ne suffit pas que le vendeur prouve à titre de défense que l'acheteur se trouvait à même de prendre connaissance de leur existence ; il faut qu'il établisse que l'acheteur a effectivement connu leur existence. Spécialement, lorsque ces servitudes et droits réels se trouvaient énumérés dans le contrat par lequel le vendeur avait acheté les terrains, la simple mention dans le contrat de vente de la date du susdit contrat et du numéro de sa transcription est insuffisante. De plus cette mention ne peut être considérée comme un commencement de preuve par écrit, en vertu de l'art. 217 C.C., de la connaissance de l'acheteur, puisqu'elle émane du vendeur lui-même.
