وضع المدعى مظلة من قماش أمام محل تجارته لتقى بضائعه من أشعة الشمس من غير أن يكون عنده رخصة بذلك فأزالها البوليس بدون اتخاذ الطرق القانونية وبدون أعلانه وتسبب عن ذلك تلف المظلة والحاق ضرر بالبضائع فرأت المحكمة أنه كان يجب على المدعى أن يحصل على رخصة قبل وضع المظلة وقررت : أولا ـ ان الحكومة مسئولة عن التلف الذى حصل للمظلة والضرر الذى لحق البضائع ثانيا ـ انه عند تقدير الضرر يجب مراعاة قاعدة أنه عند اشتراك الطرفين فى الاهمال توزع المسئولية عليهما
Summary (English)
SUMMARY TRIBUNAL OF ASSIUT 7 SEPTEMBER 1909. M. Muhammad Bassiouny Bey (J.). MUHAMMAD HASAN FARWIZ v. MUDIRIA OF ASSIUT. Tort—Both parties in fault—Measure of damages. The plaintiff, without obtaining a licence, had fixed a piece of sail-cloth in front of his shop to protect his goods from injury by the sun. The police, without taking legal proceedings, and without notice to the plaintiff, removed the sail-cloth, thereby causing the destruction of the sail-cloth and causing injury to be done to the goods of the plaintiff. The Court found that a licence ought to have been obtained. Held :— (1) That the Government was responsible for the damage done to the sail-cloth, and for the injury caused to the goods of the plaintiff by its removal ; but (2) That, in assessing the damages, effect must be given to the principle that where both parties are in fault, the damages will be apportioned.

[24] (Page […]) TRIBUNAL DE JUSTICE SOMMAIRE D'ASSIOUT ([…] 1909) M. Mohamed […] Bey (J.) […] contre […] [سطرا المبدأ غير مقروءين] Le demandeur avait, sans autorisation, fixé un morceau de toile à voile devant sa boutique, afin de protéger ses marchandises contre les rayons du soleil. La police, sans intenter des poursuites judiciaires et sans en donner avis au demandeur, enleva la toile, entraînant ainsi la destruction de celle-ci et causant préjudice aux marchandises du demandeur. Le tribunal estima que le demandeur aurait dû obtenir une autorisation, Il fut jugé : (1) Que le gouvernement était responsable de la destruction de la toile et du préjudice causé par son enlèvement aux marchandises du demandeur ; mais (2) Que dans l'évaluation des dommages-intérêts il fallait faire application du principe que lorsque les deux parties sont en faute, les dommages intérêts seront répartis entre elles.
