اذا حكم على جملة متهمين لارتكابهم جريمة الضرب فى واقعة مضاربة واحدة فمسؤليتهم المدنية تكون بطريق التضامن ولو كان الحكم عليهم بالتطبيق لمواد مختلفة من قانون العقوبات بالنسبة لجسامة الاصابات التى أحدثها كل منهم

COURT OF CASSATION 28 DECEMBER 1907. MM. Bond (Pres.): De Hults, Abd-el-Aziz Kahil Bey, Amos, Ahmad Zulfikar Bey (JJ.): Abd-el-Hamid Hilmy Effendi (State Rep.). HASSAN MUHAMMAD AND OTHERS v. STATE REPRESENTATIVE Civil liability—Joint and several—Different penalties. (C.C. arts. 150, 151.) Where several offenders are convicted of the same assault and battery their civil liability is joint and several notwithstanding the fact that, the injuries inflicted by some having been more grave than those inflicted by the others, they are sentenced under different articles of the Penal Code.

HASSAN MOHAMED ET AUTRES contre MINISTÈRE PUBLIC Responsabilité civile — Solidarité — Peines différentes. (C.C. arts 150, 151). Quand plusieurs prévenus sont condamnés pour coups et blessures dans une même rixe, leur responsabilité civile est solidaire nonobstant le fait qu'à raison d'une gravité différente des blessures ils ont été condamnés par application d'articles différents du Code pénal.
