السمسار وكيل وعلى ذلك فأتعابه قابلة للتعديل من المحكمة طبقا للمادة ٥١٤ من القانون المدنى وتراعى المحكمة عند تقديرها تلك الاتعاب اهمية العمل والوقت والمشقة اللذين استوجبهما واتفاق البائع والسمسار على أن أتعاب هذا الأخير يدفع نصفها هو اليه والنصف الثانى يدفعه المشترى لايكون سببا فى الزام البائع بدفع النصف الذى تخصص على المشترى اذا امتنع هذا الاخير عن دفعه

TRIBUNAL OF CAIRO (Judgment on Appeal). 29 OCTOBER 1907 MM. Mahmoud Rashaad Bey (Pres.); Megalos Caloyanni, Ibrahim Wageh Effendi (JJ.). YASIN MAHMOUD BEY AND ANOTHER v. AHMAD HASSAN Brokerage—Commission—Powers of the Court—Promise for a third party. (C.C. Art. 514). A broker is a mandatary, and as such his remuneration is subject to the control of the judge under Art. 514 C.C. The Court, in fixing the remuneration, will take account of the time spent on the work, the trouble which it entailed, and its importance. An agreement by a vendor with a broker for commission payable half by him (the vendor) and half by the purchaser, does not render the vendor liable to pay the half commisson expressed to be payable by the purchaser, in the event of the purchaser refusing to pay it.

YASIN MAHMOUD BEY ET UN AUTRE contre AHMED HASSAN Courtage — Salaire — Pouvoirs du tribunal — Promesse pour autrui. (C.C. Art. 514). Un courtier est un mandataire, et comme tel son salaire est sujet à l'arbitrage du juge aux termes de l'Art. 514 C.C. Le tribunal, en fixant le salaire, prendra en considération le temps demandé par le travail, la peine qu'il exigeait, et son importance. La stipulation par le vendeur d'une rémunération payable au courtier moitié par lui (le vendeur) et moitié par l'acheteur, ne rend pas le vendeur responsable du payement de la moitié stipulée payable par l'acheteur, en cas de refus par ce dernier de la payer.
