المبادئ المستخلصة
إن الفقرة الثانية من المادة ١٩٨ من قانون العقوبات التى تعاقب على القتل بالاعدام اذا سبقته أو تلته أو اقترنت به جناية أخرى قد جعلت فى الواقع هاتين الجريمتين جناية واحدة خاصة يعاقب على الشروع فيها كما يعاقب على الشروع فى أى جريمة أخرى فتطبق فى هذه الحالة الفقرة الثانية من المادة ١٩٨ مع القواعد العامة المتعلقة بالشروع . وقد حكمت المحكمة بأن الشروع فى القتل الذى سبقه شروع فى سرقة ذات ظروف مشدّدة (المادة ٢٧٣ عقوبات) يعاقب بالمواد ١٩٨ فقرة ثانية و٤٥ و٤٦ من قانون العقوبات لا بالمواد ١٩٨ فقرة أولى و٢٧٣ و٤٥ و٤٦ مع مراعاة المادة ٣٢ عقوبات .

COURT OF CASSATION. 27 OCTOBER 1917. MM. Yahia Ibrahim Pasha (Pres.); Abdul Aziz Kahil Pasha, Muhammad Tewfik Rifaat Bey, Soudan, Yussef Suliman Bey (JJ.); Rizkalla Simaika Bey (State Rep.). ADHAM ABDEL HALIM AND OTHERS v. STATE REPRESENTATIVE. Wilful homicide—Concomitance of homicide with another crime—Attempt—Penalty. (Art. 198 § 2, 45, 46 P.C.) Article 198, Paragraph 2, P.C., which punishes wilful homicide by death where it is preceded, accompanied or followed by another crime, makes in reality these two crimes into a single special offence. Attempt to commit such offence is, therefore, punishable like any other attempted offence, that is to say by the combined application of the above-mentioned paragraph and of the general rules as to attempt. Held, that attempted homicide, preceded by an attempted theft with aggravating circumstances (Art. 273 P.C.), falls under Articles 198, Paragraph 2, 45, and 46 P.C., and not under Articles 198, Paragraph 1, 273, 45, and 46, combined with Article 32 P.C.

ADHAM ABDEL HALIM ET AUTRES contre MINISTÈRE PUBLIC. Meurtre—Concomitance du meurtre avec un autre crime—Tentative—Peine. (Art. 198, § 2, 45, 46. C.P.) L'article 198, alinéa 2, C.P., qui punit de la peine de mort le meurtre précédé, accompagné ou suivi d'un autre crime, érige, en réalité, ces deux crimes en une seule infraction spéciale. La tentative de cette infraction est donc punissable à l'exemple de toute tentative, c'est-à-dire par l'application combinée du susdit alinéa et des règles générales concernant la tentative. Jugé, que la tentative de meurtre, précédée d'une tentative de vol qualifié (Art. 273 C.P.), tombe sous l'application des articles 198, alinéa 2, 45 et 46 C.P., et non des articles 198, alinéa 1er, 273, 45 et 46, combinés avec l'article 32 C.P.
