٢٦ —Acceptor— "Aval" —Defence against holder.— Neither the acceptor of a bill of exchange nor the person who has given an aval in his behalf can avail himself, as against a holder in due course, of a mere personal defence available against a prior party. (App. 10 April 1907; No. 88).
٢٧ — Form of indorsement—Omission of value received.—An indorsement of a bill of exchange in which it is not stated that value has been received is an imperfect indorsement and the indorsee takes with all the equities attaching to the bill. (App. 8 March 1908; No. 125, II).
٢٨ —Surety.—Nature of Obligation.—Suretyship, as an accessory obligation, is civil or commercial according to the nature of the principal obligation. The obligation of the surety for payment of a bill of exchange is a commercial one whether it is written on the bill or results from a separate instrument. (App. 8 March 1908; No. 125, I).

٢٩ —Adjoining owner—Rights and duties.—When the owner of a wall which encloses the land of an adjoining owner has, for good reasons, destroyed the wall, he cannot be compelled to rebuilt it. On the other hand the adjoining owner is not under any obligation to contribute towards its rebuilding, if undertaken by the owner. The special form of co-ownership in boundary walls and fences provided for by the French Civil Code art. 653 (mitoyenneté), and its resulting obligations, have not been introduced into the Native Civil Code. ٢٦ 26. — Complice condamné comme coauteur — Défaut d'intérêt. — Un jugement qui condamne deux personnes comme coauteurs d'une infraction, alors qu'en fait l'une des deux était complice, n'est pas susceptible de cassation de ce chef, parce que la peine est la même pour les coauteurs et pour les complices. ٢٧ 27. — Excuse absolutoire — Existence — Pouvoir de contrôle. — Quand la Cour d'assises a constaté comme fait l'inexistence d'une excuse absolutoire ou d'une cause de justification déterminée, semblable condamnation échappe au contrôle de la Cour de cassation. (Cass. 28 décembre 1907, N° 28).
٢٨ 28. — Extrait du jugement — Remise tardive par le greffe. — Les nullités substantielles de la procédure susceptibles de justifier un pourvoi en cassation en vertu de l'art. 229 C.I.C. sont les nullités provenant d'un fait ou d'une omission de la part du tribunal. L'omission par le greffe de remettre à l'intéressé, sur sa demande, un extrait du jugement par application de l'art. 231 § 4 C.I.C. ne constitue pas, en conséquence, un motif de cassation. ٢٩ 29. — Mémoire contenant les moyens — Mentions. — Quand plusieurs condamnés représentés par un même avocat ont tous cacheté le pourvoi en cassation, l'omission accidentelle du nom de l'un d'eux dans le mémoire contenant les moyens de cassation, ne prive pas celui-ci du bénéfice de poursuivre le pourvoi. (Cass. 28 septembre 1907, N° 25, II).
٣٠ 30. — Pourvoi — Forme — Déclaration. — Le pourvoi en cassation fondé sur l'art. 229 du C.I.C. ne peut être formé que par une déclaration faite en conformité de l'art. 231, § 1 du C.I.C. La présentation des motifs du pourvoi ne peut pas, en conséquence, être considérée comme équivalente à la déclaration. (Cass. 15 février 1908, N° 97).
٣١ 31. — Question de fait — Faux — Préjudice. — La constatation dans un jugement qu'un acte faux a causé ou qu'il a été de nature à causer un préjudice est une constatation de fait ; elle échappe, dès lors, au contrôle de la Cour de cassation. (Cass. 28 mars 1908, N° 108).

٣٠ — Accessory convicted as principal — Want of interest.—The fact that a judgment convicts two persons as principals when one of them was, in fact, an accessory does not render the judgment liable to be quashed since the penalty is in both cases the same. (Cass. 15 Feb. 1908; No. 56).
٣١ —Declaration—Form.—A motion to have a judgment discharged, under art. 229 C.Cr.Pr., can be entered only by means of a declaration made in pursuance of art. 231, § 1 C.Cr.Pr. The presentation of the grounds of the motion cannot, therefore, be deemed equivalent to such a declaration. (Cass. 15 Feb. 1908; No. 97).
٣٢ —Extract of judgment—Delivery by office of Court out of time.—Substantial defects of procedure, sufficient to support a motion to discharge a judgment under art. 229 C.Cr.Pr. are defects due to the act or omission of the Court. The failure of the office of the Court to comply with an application for an extract from a judgment, made by an interested party in pursuance of art. 231, § 4 does not afford ground for such a motion. (Cass. 28 March 1908; No. 119).
٣٣ —Memorandum of grounds — Contents. — When several convicted persons, represented by the same advocate, have all sealed the notice of motion to quash an appeal judgment, the accidental omission of the name of one of them from the memorandum of the grounds of the motion does not deprive him of the right to continue proceedings.—(Cass. 28 Sept. 1907; No. 25 II).
٣٤ —Question of fact—Exculpatory circumstance.—When the Court of Assize has found, as a fact, that a particular exculpatory circumstance or ground of justification does not exist, such finding cannot be reviewed by the Court of Cassation.—(Cass. 28 Dec. 1907; No. 28).

٣٤ 34. — Loi sur le recrutement militaire — Peines. — L'article 2 du décret promulguant le Code pénal (Loi N° 3, 1904) qui donne au juge la faculté de prononcer la peine de l'emprisonnement ou de l'amende alors que la loi antérieure impose l'obligation de prononcer cumulativement les deux peines, s'applique a fortiori au cas où l'addition d'une amende à l'emprisonnement était facultative, tel que dans le cas de l'article 131 de la loi sur le recrutement militaire. ٣٦ —Interdicted person accused—Joinder of guardian.—A claim by a civil claimant can be entertained in criminal proceedings against a person who is under tutelage on account of mental infirmity, although the guardian is not joined as a party. (Cass. 20 Aug. 1907; No. 9).
٣٧ —Joinder of claimant on appeal.—The person who alleges himself wronged by the commission of an offence cannot institute a claim as civil claimant on the hearing of an appeal in a prosecution. (Trib. App. Tanta, 23 Feb. 1908; No. 76).
٣٨ — Withdrawal—Right of action before civil Court.—A person who appears as civil claimant in a prosecution, but discontinues his claim before the close of the proceedings, is not thereby debarred from bringing an action for damages, in the same matter, before a civil Court.
