renvoi١٢٢ 122. — Avocat — Mandat — Renonciation au droit d'appel ou des témoins. — L'avocat d'un accusé devant la Cour d'assises possède le même droit que l'accusé lui-même de renoncer à appeler des témoins à décharge dûment cités par le juge de renvoi, et l'accusé ne peut pas demander la nullité du jugement en se basant sur cette renonciation. (Cass. 20 août 1907, N° 10).
١٢٣ 123. — Composition du tribunal d'appel. — Il n'y a pas nullité substantielle lorsqu'un des juges jugeant un appel de délit avait siégé dans le tribunal de premier degré devant lequel les débats avaient été ouverts et des témoins entendus, si les débats ont été renvoyés et réouverts devant un autre juge. (Cass. 25 janvier 1908, N° 82).
١٢٤ 124. — Juge de renvoi — Audition de la partie civile. — Le juge de renvoi a, dans l'exercice de son pouvoir discrétionnaire, la faculté d'entendre la partie civile nonobstant le fait que l'art. 11 de la loi sur les Cours d'assises (N° 6, 1905) ne mentionne pas la partie civile parmi les personnes auxquelles le juge de renvoi peut demander des explications. ١٢٥ 125. — Juge de renvoi — Audition de la partie civile. — Le juge de renvoi n'est pas obligé de permettre à la partie civile de comparaître devant lui, mais il en a la faculté s'il estime que sa présence peut être utile pour faire ressortir la vérité. (Ord. ren. Caire 11 mai 1908 et Trib. som. Benha 11 février 1908, N° 80).
١٢٦ 126. — Juge de renvoi — Ordonnance en conflit avec le jugement du tribunal — Devoir du parquet. — Le juge de renvoi décida que les faits allégués par le parquet ne constituaient en droit qu'un délit. Le tribunal sommaire, auquel l'affaire fut déférée par le parquet, et le tribunal central en appel, décidèrent que les faits constituaient, en droit, un crime. Lorsque l'affaire fut de nouveau déférée au juge de renvoi, ce dernier réitéra sa première décision. La Cour de cassation jugea : (a) que l'ordonnance du juge de renvoi ne liait pas les tribunaux correctionnels ; (b) que le juge de renvoi n'était pas compétent pour statuer une seconde fois ; et que le parquet, après le jugement du tribunal central, aurait dû saisir directement la Cour d'assises en vertu de l'art. 189 C.I.C. (Cass. 29 septembre 1907, N° 13, II).
١٢٧ 127. — Procès-verbal d'audience — Mentions — Prestation de serment. — L'absence de mention dans le procès-verbal d'audience, qu'un des témoins à charge, a prêté serment, ne constitue pas une nullité substantielle de la procédure. (Cass. 28 décembre 1907, N° 41).
١٢٨ 128. — Rédaction des dépositions — Omission du juge d'approuver. — Constitue une nullité substantielle de la procédure l'omission de la part du juge, en matière correctionnelle, d'approuver la note tenue par le greffier conformément aux art. 170 et 186, C.I.C. (Cass. 9 mai 1908, N° 122).
١٢٩ 129. — Serment prêté par témoins — Formule — Omission du procès-verbal d'audience. — L'omission dans un procès-verbal d'audience d'une Cour d'assises de la formule du serment prêté par les témoins ne constitue pas une nullité substantielle, aucune formule spéciale n'étant imposée par la loi. ١٢٣ 123. — Advocate. — Scope of mandate. — Abstention from calling witnesses. — The advocate of the accused before an Assize Court has the same right as the accused to abstain from calling witnesses for the defence, even though they have been summoned to appear by the committing judge, and the accused cannot afterwards rely on such abstention as invalidating the judgment. (Cass. 20 Aug. 1907; No. 10).
١٢٤ 124.—Committing Magistrate—Examination of civil claimant.—The Committing Magistrate may, in the exercise of his discretionary powers, examine the civil claimant notwithstanding the fact that he is not mentioned among the persons of whom, by art. 11, Assize Court Law (No. 4, 1905), the Magistrate may ask explanations. (Ord. Com. Tanta, 18 Dec. 1907, No. 36).
١٢٥ 125.— Committing Magistrate. — Examination of Civil claimant. — The Committing Magistrate is not bound to allow the civil claimant to appear before him, but may do so if he be of opinion that the claimant may be of assistance in the elucidation of the truth. (Ord. Com. Cairo, 11 March 1908; Sum. Trib. Benha, 11 Feb. 1908 ; No. 80, I).
١٢٦ 126.—Committing Magistrate a misdemeanour tribunal — Conflicting decisions as to nature of offence.—The committing magistrate held that the facts alleged by the Parquet constituted in law a misdemeanour only. The Summary Tribunal, to which they were then submitted by the Parquet, and the Central Tribunal in appeal therefrom, held that they constituted in law a crime. Upon a second reference to the committing magistrate, that magistrate adhered to his former opinion. Held (by the Court of Cassation) : (a) that the order of the committing magistrate was not binding upon the misdemeanour Courts ; (b) that the committing magistrate was not competent to hear the matter a second time ; and that the Parquet, upon the decision of the Central Tribunal, ought to have sent the case direct to the Assize Court under art. 189 C.Cr.Pr. (Cass. 29 Sept. 1907; No. 13, II).
١٢٧ 127.— Composition of court on appeal. — The fact that one of the judges, who tried an appeal in a case of misdemeanour, had previously sat in the Court before which the case was originally opened, and heard a witness, does not constitute a substantial defect if the hearing was then adjourned, and the case re-opened before another judge. (Cass. 25 Jan. 1908 ; No. 82).
١٢٨ 128.—Note of deposition—Omission of approval by judge.—The failure of the judge, in a case of misdemeanour, to approve the note made by the clerk of the Court in pursuance of arts 170, 186 C.Cr.Pr. is a substantial defect of procedure. (Cass. 9 May 1908 ; No. 122).
١٢٩ 129.—Record of sitting — Contents — Swearing witness.— The fact that one of several witnesses for the prosecution is not shewn, in the record of the sitting, to have been sworn is not a substantial nullity. (Cass. 28 Dec. 1907; No. 41).
