المبادئ المستخلصة
لكى يسقط حق المطالبة بكمبيالة تحت الإذن بمضى خمس سنوات طبقا للمادة ١٩٤ من القانون التجارى يجب أن يكون سبب الدين تجاريا. أما إذا كان سببه غير تجارى فتطبق قواعد القانون المدنى.

Extinctive prescription — Promissory Note — Non-commercial operation—Quinquennial prescription inapplicable.—(Art. 194 Com. C.) In order that a promissory note may be liable to the five years' prescription, under Article 194 Com. C., it must have been occasioned by a commercial operation ; otherwise, it can only be considered as an ordinary instrument of debt, subject to the rules of the Civil Code. See, as above, App. Mixte, March 15, 1911 (B.L.J., XXIII, p. 217 ; and Dec. 24, 1914 (B.L.J., XXVII, p. 84).
